FREQUENTLY ASKED
QUESTIONS:
1. Should I obtain a survey even though the lender
is not requiring one? Your lender will have coverage in their title
insurance policy for matters that would have been disclosed on a survey even if
a survey is not obtained. However, without a survey, your owner's policy will
specifically exclude coverage for any matter that a current survey may have
revealed. Surveys can reveal many title issues, including but not limited to,
encroachments, boundary line issues, setback violations, easements, Lake Norman
high water mark related issues and impervious areas.
2. What
is title insurance and why is it important to me? Obtaining title
insurance requires a one-time premium collected at the time of closing, however,
coverage lasts for as long as you own the property and even afterwards (to
protect you against claims by the person you sell to). Title insurance shifts
the risk of title defects or problems from the owner/lender/attorney to the
insurer.
3. Why should I use an attorney rather than a settlement
company to close my transaction? Attorneys and their trust accounts are
strictly regulated by the North Carolina Bar and the Goods Funds Settlement Act.
Settlement Companies however are unregulated. Attorneys can explain documents
and give professional advice regarding the legal ramifications of documents and
title issues during the closing process. Settlement Companies however, are
prohibited from explaining or giving legal advice related to documents or title
issues during the closing process. North Carolina has among the lowest rates of
title insurance claims in the nation because in this State the opinion of an
independent attorney as to the state of title is required to obtain title
insurance and because the vast majority of closings are performed by attorney's
here. Attorneys' services cost no more (and often less)than settlement companies
services.
